01 About Rewear

Rewear ("we," "us," or "our") operates a peer-to-peer fashion rental marketplace that connects individuals who wish to rent out clothing and accessories ("Lenders") with individuals who wish to rent those items ("Renters"). Rewear provides the platform, payment infrastructure, and AI-powered tools to facilitate these transactions — we are not a party to the rental agreement between Lenders and Renters.

These Terms of Service ("Terms") govern your access to and use of the Rewear mobile application, website at joinrewear.com, and any related services (collectively, the "Platform").

02 Eligibility

To use Rewear, you must:

• Be at least 18 years of age
• Be a legal resident of a country where Rewear operates
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Platform under applicable law

By using the Platform, you represent and warrant that you meet all eligibility requirements. If you use the Platform on behalf of a business, you represent that you have authority to bind that business to these Terms.

03 Your Account

You must create an account to access most features of Rewear. When creating your account, you agree to:

• Provide accurate, current, and complete information
• Keep your password secure and confidential
• Notify us immediately of any unauthorised account access
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain false information, violate these Terms, or are inactive for an extended period. You may not transfer your account to another person.

04 Listings & Bookings

Lenders may list items for rent by providing accurate descriptions, photographs, pricing, and availability. By creating a listing, you represent that:

• You own the item or have the right to rent it out
• The item is as described and in the stated condition
• The item is free from any legal encumbrances
• Renting the item does not violate any law or third-party rights

Renters may browse listings and submit booking requests for desired rental periods. A booking is confirmed only when the Lender accepts the request and payment is successfully processed. Rewear reserves the right to remove any listing that violates these Terms or applicable law.

05 Payments & Fees

All prices on the Platform are displayed in the local currency. Payments are processed securely through our third-party payment provider. Funds are held in escrow and released to the Lender within 24 hours of confirmed return.

Optional Damage Protection (approximately 8% of rental value) may be added at checkout. This covers accidental damage up to the stated item value and is assessed using our AI Condition Report system.

Refunds are governed by our Damage & Disputes policy (Section 9). Rewear does not issue refunds for change of mind after a booking is confirmed.

06 Lender Responsibilities

As a Lender, you are responsible for:

• Ensuring items are clean, in the condition described, and ready for use at the start of the rental period
• Responding to booking requests within 24 hours
• Handing over items safely and on time
• Conducting a return inspection using the AI Condition Report tool within 24 hours of receiving items back
• Resolving disputes in good faith

Lenders are independent individuals, not employees or agents of Rewear. Rewear is not liable for any loss, damage, or failure arising from a Lender's conduct.

07 Renter Responsibilities

As a Renter, you are responsible for:

• Treating rented items with reasonable care throughout the rental period
• Returning items in the same condition they were received, subject to normal wear
• Returning items on time — late returns may incur additional daily charges
• Not subletting, selling, or gifting rented items to third parties
• Reporting any damage or issues promptly through the Platform

You are financially liable for any damage beyond normal wear and tear that occurs during your rental period, whether or not you purchased Damage Protection.

08 AI Condition Reports

Rewear uses AI-powered image analysis (powered by Google Gemini) to generate garment condition reports. These reports are intended to provide an objective assessment of an item's condition including stains, wear, fabric integrity, and damage.

Condition reports generated at the time of return are used to assess damage and inform dispute resolution. Both parties agree to the use of AI condition analysis as part of the Rewear rental process.

09 Damage & Disputes

If damage is identified upon return:

• The Lender must raise a damage claim within 48 hours of item return via the Platform
• Evidence must include AI Condition Reports from both the start and end of the rental
• Rewear's Trust & Safety team will review the claim and make a determination within 5 business days
• If Damage Protection was purchased, eligible claims will be covered up to the item's stated value

Rewear's determination on damage disputes is final and binding. We reserve the right to charge the Renter's payment method on file for agreed damage amounts. Fraudulent claims by either party may result in account suspension.

10 Prohibited Conduct

You may not use the Platform to:

• List or rent counterfeit, stolen, or illegally obtained items
• List items that are hazardous, require special licenses, or are prohibited by law
• Conduct transactions outside the Platform to avoid fees
• Harass, threaten, or abuse other users
• Create fake listings, reviews, or accounts
• Use the Platform to engage in any fraudulent activity
• Scrape, copy, or redistribute Platform content without permission
• Circumvent, disable, or interfere with Platform security features

Violation of these prohibitions may result in immediate account termination and, where applicable, referral to law enforcement.

11 Intellectual Property

The Rewear name, logo, design, and all Platform content are owned by or licensed to Rewear and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

By submitting photos, descriptions, or other content to the Platform, you grant Rewear a non-exclusive, royalty-free, worldwide licence to use, display, and promote that content in connection with operating and marketing the Platform. You retain ownership of your content.

12 Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. Rewear does not warrant that:

• The Platform will be uninterrupted, error-free, or secure
• Any listings, reviews, or AI reports are accurate or complete
• Transactions between users will be completed successfully

Rewear is a marketplace platform. We do not own, inspect, or verify the condition of items listed. Your use of the Platform is at your own risk.

13 Limitation of Liability

To the maximum extent permitted by law, Rewear shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any transaction conducted through it.

Our total liability for any claim arising from these Terms shall not exceed the greater of (a) the total fees paid by you to Rewear in the 3 months preceding the claim, or (b) USD $100.

14 Termination

You may close your account at any time by contacting us at hello@joinrewear.com. We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Platform.

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including Sections 11, 12, 13, and 15) will survive.

15 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

16 Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top and, for material changes, notify you by email or in-app notification. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
